Environmental law expertise

When you hire one of Ecogain's environmental lawyers, you get the environmental legal advice you need. We act in an advisory capacity right from the drafting of an application and throughout the entire process, including any negotiations. Our environmental lawyers help you at an early stage to assess the various documents and applications that may be needed for your particular project. If you are at an advanced stage of your project, we are happy to help you quality review the documentation already produced, such as a permit application. Our environmental lawyers can also assist with drafting opinions, responding to injunctions and being responsible for contacts with authorities and various parties.

Environmental law support and advice on planning and construction issues

Our ambition is for you as a client to get the support you need when you need it. Our environmental lawyers support you based on your individual needs, which may include advice on project design, risk assessments, quality review of existing documentation, interpretation of legal provisions, decisions and judgments. The support our environmental lawyers offer includes everything from major legal issues in application cases to detailed issues in cases concerning, for example, shoreline protection, supervision, species protection or penalty cases. In addition to environmental law, we are also well versed in the provisions of the Planning and Building Act, and can therefore also provide advice on building permits, detailed plans, building sanction fees and penalty cases under the Planning and Building Act.

Legal expertise on species protection

Ecogain is a knowledge leader when it comes to species and nature on land and in water and has a deep and broad expertise in both law and ecology. By joining forces with us, you get the opportunity to own a large part of the knowledge yourself. The protection of certain species can often end up in focus in, among other things, permit assessments, and this focus has increased over time. We keep up to date on the legal situation and legal development of species protection in Sweden and also in terms of EU law and EU law practice. We help you to produce a reliable basis with assessments based on the starting points required by current species protection legislation. Our environmental lawyers act as advisors in species protection issues; based on the challenges that may exist in your particular project and highlight various alternative ways forward and make risk assessments. We can also help with the preparation of exemption applications under sections 14 and 15 of the Species Protection Ordinance.

Procedural guidance

Environmental procedural law can give rise to many questions. How late in the process can a claim be made? If several claims are to be presented - in what order should they be presented? Who has the right to complain about an inspection decision or a permit decision? Why is the County Administrative Board the first instance in some cases and the Land and Environment Court in other cases? What is the difference between dismissal, remittal and rejection? When does a case risk being referred back? The list of questions is long and procedural issues are often of decisive importance when the case is examined. Environmental procedural law is unique and different procedural rules apply to different types of cases. Our environmental lawyers have extensive court experience and will help you to clarify these issues. In order for you as a client to get the greatest benefit from our procedural advice, we recommend that our environmental lawyers are involved as early as possible.
